IMPORTANT: BY REGISTERING FOR OUR SERVICES, REQUESTING CANDIDATE
PROFILES, OR PAYING ANY SERVICE FEES TO DREAM NANNIES, YOU AGREE TO
BE BOUND BY THESE TERMS AND CONDITIONS. PLEASE READ THEM CAREFULLY.
These Terms apply to the Client and Dream Nannies Pty Ltd trading as DREAM NANNIES .
1. Service Fees
The Client agrees to pay the fees for the recruitment services provided by the Agency as
follows:
 Registration Fee: A non-refundable fee is payable upon application to commence
the recruitment and screening process. This fee covers administrative costs,
advertising, and initial candidate vetting. This fee is required to initiate the search.
 Placement Fee: A final placement fee is payable once a Candidate introduced by
the Agency accepts an offer of employment. This fee will be confirmed at the time of
your application and is invoiced on the Nanny’s first day of work.
 Trial Hours: Any trial periods must be paid for by the Client directly to the Nanny at
an agreed hourly rate.

2. Nature of Service & Legal Status
The Agency acts as a permanent recruitment and introduction service. We source,
screen, and introduce Candidates to the Client.
 The Employer: The Client is the legal employer of the Nanny. The Agency is an
introduction service only and is not a party to any employment contract.
 Legal Obligations: The Client is responsible for all employer obligations, including
Award-compliant wages (Miscellaneous Award), Superannuation, PAYG tax
withholding, and WorkCover insurance.
 Professional Advice: We acknowledge and agree that it is the responsibility of us
as the Client to seek advice regarding our responsibilities as an employer.

3. Payment Terms

 Invoicing: The Placement Fee is invoiced on Day 1 of the Nanny’s
commencement and is due for payment immediately.
 Direct Hiring & Confidentiality: All Candidate introductions are strictly confidential.
If the Client engages a Candidate introduced by the Agency within 12 months of the
initial introduction without notifying the Agency, or refers a Candidate to a third party
(e.g., a friend or relative) who subsequently hires them, the Client shall be liable for
the full Placement Fee.

4. Screening & Working with Children Checks
 Agency Verification: The Agency verifies that all Candidates hold a current
Working with Children Check (WWCC) or Blue Card (QLD) at the time of
introduction.

 Ongoing Compliance: As the employer, the Client is responsible for ensuring the
Nanny’s WWCC/Blue Card remains valid throughout their employment.

5. Replacement Guarantee
If the employment terminates within the first 4 weeks (30 days) of commencement, the
Agency will provide one free replacement search, provided:
1. All Agency fees (Registration and Placement) were paid in full and on time.
2. Employer Compliance: The Client has met all terms of the employment agreement
and these Agency Terms, including providing a safe work environment and meeting
all legal pay and tax obligations.
3. Consistency of Role: The job description, hours, and location have not changed
significantly from the original brief provided to the Agency.
4. The Agency is notified in writing within 48 hours of the termination.
 Exclusions: The guarantee does not apply if the termination is due to redundancy, a
change in the family & circumstances (e.g., moving house), or if the Client has
breached employment laws.
 Note: No refunds are provided.
6. Vehicle, Driving & Liability
 Vehicle Safety: If the Nanny is required to drive the Client’s vehicle, the Client must
ensure the vehicle is roadworthy, registered, and fully insured (including cover for the
Nanny). The Client is responsible for any insurance excess or damages.
 Suitability: While the Agency uses reasonable endeavours to verify a Candidate's
background and references, the final decision to employ a Candidate rests solely
with the Client.
 Release of Claims: The Agency shall not be liable for any loss, damage, expense,
or personal injury caused by the Candidate’s acts or omissions.
7. General
 Variation: DREAM NANNIES reserves the right to modify these Terms at any time.
 Governing Law: These Terms are governed by the laws of Queensland.

ACKNOWLEDGEMENT: By submitting a request for a Nanny or paying any fees to DREAM
NANNIES, you acknowledge that you have read, understood, and agree to be bound by
these Terms and Conditions
